  25. An act relating to radio communication; creating ss. 125.0185 and 166.0435, F.
  26.       S.; prohibiting  counties and municipalities from  enacting or enforcing
  27.       restrictive ordinances  governing amateur radio  antenna; providing  for
  28.       construction of such antennas  in conformance with federal requirements;
  29.       providing for the applications of the act; providing an effective date.
  30.  
  31.             Be It Enacted by the Legislature of the State of Florida:
  32.  
  33. Section 1.  Section 125.0185, Florida Statutes, is created to read:
  34.  
  35. 125.0185   Amateur radio  antennas; construction  in conformance  with federal
  36. requirements.
  37.  
  38. (1)  No county shall enact or enforce  any ordinance or regulation which fails
  39. to  conform to the limited preemption entitled ``Amateur Radio Preemption, 101
  40. FCC  2d 952 (1985)'' as issued by  the Federal Communications Commission.  Any
  41. ordinance or  regulation adopted  by a county  with respect  to amateur  radio
  42. antennas shall conform  to the  above cited limited  preemption, which  states
  43. that local  regulations  which  involve placement,  screening,  or  height  of
  44. antennas  based on health, safety, or aesthetic considerations must be crafted
  45. to reasonably accommodate amateur communications and to  represent the minimum
  46. practicable regulation to accomplish the local authority's legitimate purpose.
  47.  
  48. (2)  Nothing in this section shall effect any applicable provisions of chapter
  49. 333.
  50.  
  51. Section 2.  Section 166.0435, Florida Statutes, is created to read:
  52.  
  53. 166.0435   Amateur radio  antennas; construction  in conformance  with federal
  54. requirements.
  55.  
  56. (1)  No municipality shall enact  or enforce any ordinance or regulation which
  57. fails  to  conform   to  the  limited  preemption   entitled  ``Amateur  Radio
  58. Preemption,  101 FCC 2d 952  (1985)'' as issued  by the Federal Communications
  59. Commission.   Any  ordinance  or regulation  adopted  by a  municipality  with
  60. respect to  amateur radio antennas  shall conform  to the above  cited limited
  61. preemption,  which  states that  local  regulations  which involve  placement,
  62. screening,  or  height  of antennas  based  on  health,  safety, or  aesthetic
  63. considerations  must  be  crafted   to  reasonably  accommodate  amateur  com-
  64. munications and to represent the minimum practicable regulation to  accomplish
  65. the local authority's legitimate purpose.

  67. (2)  Nothing in this section shall effect any applicable provisions of chapter

  70. Section 3.  This act shall take effect upon becoming a law.
